Sovereign Immunity, Non-Custodial Safeguards, and Judicial Confidentiality
This Sovereign Privacy Policy and Technical Operating Covenant ("Covenant") governs all algorithmic analysis, brief ingestion, vectorized memory concordance, and query processing conducted across the Shadow Beacon Enterprise Network. Shadow Beacon operates under strict mathematical non-custody. We acknowledge that enterprise clients—including AmLaw 100 litigators, corporate general counsel, and forensic advisors—routinely process materials protected by the Attorney-Client Privilege, Work-Product Doctrine, and Joint-Defense Agreements. Shadow Beacon's hardware architecture is engineered to guarantee zero retention, zero human inspection, and absolute mathematical non-waiver.
1. Architectural Non-Custodial Model
Section 1.1 Non-Custodial Architecture. Shadow Beacon utilizes a physically air-gapped, stateless micro-kernel architecture. At no point in the lifecycle of any litigation discovery document, appellate brief draft, or SEC inquiry file does Shadow Beacon take permanent legal or cryptographic custody of client property. All document parsing and vector indexing actions occur within verified Confidential Virtual Machines (CVMs) executing inside AMD SEV-SNP cryptographic isolation rings.
Section 1.2 Volatile DRAM Zeroization. The processing pipeline operates strictly within volatile Dynamic Random-Access Memory (DRAM). Input tokens, intermediate contextual embeddings, and output generative reasoning chains are uncoupled from write privileges on underlying block storage devices. As a condition of service, storage mounts accessible to execution nodes are hardware-configured as write-blocked read-only mediums, precluding physical state serialization.
Section 1.3 Tenant Isolation Bounds. Multi-tenancy is cryptographically abolished. Each enterprise concordance query is spun into an ephemeral Docker runtime assigned dedicated hardware cores. Upon transmission of the final response frame, the parent thread invokes an unrecoverable SIGKILL, dropping entropy buffers and reclaiming hardware allocations back to the zeroed pool.
"By operation of this Section 1, Shadow Beacon provides a neutral electronic conveyance and ephemeral analytical facility. Under no theory of statutory bailment, state common law, or Federal Rule of Civil Procedure 34(a)(1) shall Shadow Beacon be deemed a custodian of records, possessor of confidential material, or electronic storage repository for the Client's work-product."
2. Ephemeral RAM & Transient Ingestion Protocols
Section 2.1 Transient Lifecycle. The ingestion of briefs, legal memoranda, judicial transcripts, and evidentiary depositions is governed by the Shadow Beacon Ephemeral Pipeline Protocol (SBEPP-v4). From the instant of TLS 1.3 termination inside the hardware-isolated gateway, data persists exclusively in cryptographically sealed RAM registers for an execution duration strictly capped at 240 seconds.
Section 2.2 Cold Boot & Remanence Defense. To defeat data remanence attacks and physical memory capture techniques, all physical RAM banks leverage continuous AES-XTS-256 hardware memory encryption with on-die keys generated by an air-gapped quantum entropy chip. Keys are destroyed every 60 seconds and instantly zeroed upon any chassis breach or thermal anomaly.

3. Non-Ingestion & Training Prohibition
Section 3.1 Strict Prohibition on Machine Learning Training. Shadow Beacon expressly covenants, represents, and warrants that under no legal doctrine or technical circumstance shall any document, textual fragment, prompt, citation request, metadata token, or work product generated by the Client be utilized to train, re-train, fine-tune, calibrate, or validate any base neural weights, LoRA adapters, or foundational models operated by Shadow Beacon or any third party.
Section 3.2 Algorithmic Air Gap. Large language models utilized across our sovereign fabric are frozen instances verified via SHA-512 immutable digests. Backpropagation routines are physically stripped from production model firmware. Weight alteration is programmatically impossible in production environments.
Section 3.3 Prompt De-Identification. In the fractional second required for inference, contextual embeddings are purged of proprietary markers through automated cryptographic scrubbing that replaces named judicial entities, docket numbers, and sensitive party aliases with volatile pseudonymized tokens.
4. Hardware-Enforced Zero Retention (DoD 5220.22-M Compliance)
Section 4.1 DoD 5220.22-M Sanity Sanitization. Immediately following the termination of an active inference transaction, all volatile address spaces allocated to the session are overwritten pursuant to the Department of Defense 5220.22-M National Industrial Security Program Operating Manual (NISPOM) specification: Pass 1 overwriting with fixed binary characters; Pass 2 overwriting with complements; Pass 3 overwriting with randomized pseudorandom noise sequences, verified by continuous cycle check.
Section 4.2 NIST SP 800-88 Rev. 1 Standards. In parallel, volatile page tables and unmapped registers are purged according to the "Clear" and "Purge" thresholds set forth in NIST Special Publication 800-88 Revision 1 (Guidelines for Media Sanitization). Storage controller logs preserve zero history of payload transactions.
5. Privilege Non-Waiver & TDRPC Rule 1.05 Safe Harbor
Section 5.1 Preservation of Professional Confidences. Operating within the sovereign enclave constitutes a protected technological intermediary arrangement. Transmission of materials does not constitute disclosure, publication, or waiver under Texas Disciplinary Rules of Professional Conduct (TDRPC) Rule 1.05, American Bar Association (ABA) Model Rule 1.6, or California Rules of Professional Conduct Rule 1.6.
Section 5.2 Federal Rule of Evidence 502(d) Stipulation. In accordance with FRE 502(d), disclosures within this technical medium are subject to non-waiver covenants enforceable in both federal and state judicial proceedings across all United States jurisdictions.
"The Parties agree and formally acknowledge that the automated processing, vectorized scoring, and ephemeral caching executed by Shadow Beacon's hardware does not constitute an unprivileged third-party disclosure under Texas Disciplinary Rule of Professional Conduct 1.05(b), nor does it violate ABA Formal Opinion 477R or ABA Formal Opinion 498 on virtual practice technologies. Counsel retains complete, unadulterated judicial confidentiality and work-product immunity pursuant to Fed. R. Civ. P. 26(b)(3)."
6. Subpoena Defense & Mathematical Immunity
Section 6.1 Mathematical Impossibility Defense. In the event Shadow Beacon receives any judicial subpoena, grand jury summons, national security letter, foreign letters rogatory, or court order compelling the production of Client data, Shadow Beacon's response will be mathematically determined: we cannot produce that which we do not possess.
Section 6.2 Mandatory Challenge & Prompt Notification. To the extent legally permissible under 18 U.S.C. § 2705(b) or equivalent statutes, Shadow Beacon shall give the Client immediate written notice within four (4) hours of service, enabling the Client to assert all available privileges and seek an emergency protective order or motion to quash.
7. Client Data Ownership & Cryptographic Keys
Section 7.1 Sole Title & Intellectual Property. The Client retains sole, exclusive, and unencumbered ownership of, and title to, all uploaded files, user queries, analytical output, statutory concordance matrices, and synthetic counter-arguments. Shadow Beacon asserts zero intellectual property rights or derivative license claims.
Section 7.2 Bring Your Own Key (BYOK) Enforcement. Enterprise tenants maintain their private keys via external Hardware Security Modules (HSM) conforming to FIPS 140-3 Level 4 validation. Shadow Beacon operators never have access to cleartext master keys; session credentials are encrypted with client public certificates and unwrapped exclusively within the SEV-SNP cryptographic core.
8. Institutional Audit Rights & SOC 2 Telemetry
Section 8.1 Continuous Telemetry Ledger. System provenance is perpetually recorded to an append-only, tamper-evident cryptographic Merkle tree ledger. Clients can independently verify the hash state of their enclave at any millisecond to prove that no unauthorized read operations, memory dumps, or network egress events transpired during query execution.
Section 8.2 Third-Party Forensic Access. Institutional clients retaining annual enterprise licenses have the contractual right to commission an independent audit conducted by a Big Four accounting firm or accredited CREST-certified forensic laboratory to verify compliance with this Covenant.
9. Global Data Sovereignty (Swiss Enclaves & US-GovCloud)
Section 9.1 Jurisdiction-Locked Compute. Shadow Beacon provisions sovereign computational rings locked strictly to client-designated borders. International clients may elect execution within the Swiss Data Haven (Fortress Mount 10, Canton Uri), insulated from the CLOUD Act and extraterritorial data demands.
Section 9.2 FedRAMP High & ITAR Alignment. For United States defense litigators and government advisory practices, computational clusters operate under FedRAMP High baseline controls and International Traffic in Arms Regulations (ITAR) personnel screening protocols.
